These Terms of Service govern your use of the PhotoIQ platform and services. Please read them carefully before using our AI-powered product photography tools.
1. Acceptance of Terms
By accessing or using PhotoIQ, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including visitors, free trial users, and paying subscribers.
2. Service Description
PhotoIQ provides AI-powered product photography generation, including model photoshoots, preset-based styling, custom preset creation, video generation, background removal, and photo editing. Features are subject to your subscription plan and available credits.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials and for all activities under your account. You must provide accurate information and promptly update it if it changes. You may not share account access or use the platform for unauthorized purposes.
4. Content Ownership
You retain all rights to your product images, generated photos, custom AI models, and custom presets. PhotoIQ does not claim ownership of any content you create or upload. We do not use your content to train our AI models or share it with third parties.
5. Credits and Billing
Credits are used for AI generation features and are allocated based on your subscription plan. Unused credits from monthly allocations roll over for up to 90 days. Refunds for unused credits are handled on a case-by-case basis. Subscription renewals are automatic unless cancelled.
6. Acceptable Use
You may not use PhotoIQ to generate content that is illegal, harmful, deceptive, or infringes on others' rights. You may not attempt to reverse-engineer, copy, or redistribute the platform's AI models or technology. Automated scraping or bulk access beyond normal usage is prohibited.
7. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We reserve the right to modify, suspend, or discontinue features with reasonable notice.
8. Limitation of Liability
PhotoIQ is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount you paid in the 12 months preceding any claim.
9. Termination
Either party may terminate the agreement at any time. Upon termination, you retain access to download your content for 30 days. We reserve the right to terminate accounts that violate these terms immediately and without notice.
10. Changes to Terms
We may modify these terms with 30 days' notice via email or platform notification. Continued use after changes take effect constitutes acceptance. Material changes will require explicit acknowledgment.
